Update on the Avaiden Matter

This is our mail.

On Tuesday the owners of PELICAN FLY (Texeira family) lodged an appeal with the Racing Appeals Tribunal stating the NSW Harness Racing Appeal Tribunal did not have jurisdiction to hear the appeal of AVAIDEN.

Mr Texeira engaged a solicitor.

The Tribunal gave Mr Texeira until 2pm Tuesday afternoon to lodge submissions regarding the jurisdiction issue.

He failed to do this and this appeal was dismissed.

At 1.30pm on Wednesday John Dumesny emailed all owners with horses in the $100,000 Newcastle Regional Championships to advise them the barrier draw would be delayed until 2.30pm the same day, unless an application for injunctive relief was served on HRNSW.

The draw has been done and the fields are now published.

The Texeira’s horse isn’t in it.

I guess this means that no application for injunctive relief was served.

What a balls up this whole thing has been on the part of HRNSW.

The owners of both horses should never have been put in this position by the Stewards, and it is utterly unfair to both parties that they have.
